Terms of Service

1. Agreement

These terms are an agreement between you and BlueValor Modifications ("we", "us"). By creating an account, placing an order or downloading a file, you agree to these terms, the Refund Policy and the Privacy Policy. If you do not agree, do not use the site.

2. Who can buy

You must be at least 18 years old, or have the permission of a parent or guardian who agrees to these terms for you. You must have the right to use the payment method you pay with.

3. Your account

You are responsible for keeping your login details private and for everything done through your account. An account is for one person and may not be shared, sold or transferred. Tell us straight away if you think someone else has access to it. We may suspend or close an account that breaks these terms.

4. Digital products and your license

Our products are digital files. They are licensed to you, not sold. When you pay for a product (or claim a free one), we give you a personal, non-exclusive, non-transferable license to install and use it on FiveM servers that you own or operate, for as long as you follow these terms.

You may not:

• share, give away, resell, rent, sublicense, leak or publicly upload any file, in whole or in part;
• include our files in a pack, bundle or server that you sell or give to others;
• claim our work as your own, or remove credits or license notices;
• reuse models, textures, lighting setups or other parts of a file in work that you distribute or sell;
• give anyone else access to your account or your download links;
• use our products outside of a game, to impersonate a real police, fire, medical or government agency, or for anything unlawful.

Editing a file for use on your own server (for example changing a livery) is allowed, as long as the edited file is not shared or sold.

Lifetime Access

Lifetime Access is a one-time purchase that gives the account that bought it a license, on the terms of this section, to every vehicle file offered in the store at the time of purchase and to every vehicle file we add to the store afterwards. In these terms:

• "lifetime" means for as long as BlueValor Modifications continues to operate the store and offer the files. It is not a promise that the store, or any particular file, will be available forever;
• we decide what we release and when. We do not promise any number of new files, any release schedule, or that any particular vehicle will be made;
• Lifetime Access covers vehicle files sold in the store. It does not include custom services (section 9) or work made to order for someone else;
• a file may be changed, replaced or withdrawn, for example if we lose the right to distribute it;
• Lifetime Access belongs to one account and cannot be shared, sold or transferred. It ends, without a refund, in the situations described in section 12;
• like every other product, Lifetime Access is delivered immediately and is not refundable, including if you bought individual files before buying it.

Some downloads are unlocked by a role in our Discord server instead of a purchase. That access lasts only while your account holds the role, and we can change which files a role unlocks.

5. Prices and payment

Prices are shown in US dollars and can change at any time. A change does not affect orders already paid for. Payments are handled by Stripe. We do not see or store your card number. You are responsible for any taxes or bank fees that apply to your purchase.

6. Delivery

Products are delivered as downloads in your account as soon as payment is confirmed. Nothing is shipped. You are responsible for downloading and keeping a copy of your files. We try to keep purchased files available in your account, but we do not promise that they will be available forever.

7. No refunds

All sales are final. Because products are delivered instantly and cannot be returned, we do not offer refunds, returns or exchanges. By checking out you ask for immediate delivery and accept that you cannot cancel the order once the download is available. The full rules, including what we do if a file is faulty and what happens after a chargeback, are in the Refund Policy, which is part of these terms.

8. Installation and compatibility

Each product page describes what the product is. You are responsible for checking that it suits your server before you buy, and for installing and configuring it. We do not guarantee that a product will work with every server, framework, game build, script or other modification, or that it will keep working after game or platform updates. Help offered through Discord is given as a courtesy and is not a guaranteed service.

9. Custom services

Custom work (vehicle debadging and livery creation) is quoted and agreed with you individually, usually through Discord. Timelines are estimates. Payments for custom work are not refundable once the work has started. Unless we agree otherwise in writing, we keep the rights to our own base models, templates and tools used to produce custom work.

10. Ownership and third-party names

The site and our original work are protected by copyright and other laws. Apart from the license in section 4, you get no rights in them.

Vehicle makes and models, agency names, badges, logos and other names or marks that appear in or alongside our products belong to their respective owners. They are used only to describe fictional content for use in a roleplay game. BlueValor Modifications is not affiliated with, sponsored by or endorsed by any vehicle manufacturer, any law enforcement, emergency service or government agency, Rockstar Games, Take-Two Interactive, or Cfx.re (FiveM).

You are responsible for making sure that the way you use our products follows the rules of the game and platforms you use them on, including the terms of Rockstar Games and Cfx.re.

11. Acceptable use of the site

You agree not to attack, probe, overload or interfere with the site; not to get around payment, licensing or download protections; not to use automated tools to collect data from the site; and not to give false information when registering or ordering. Payment fraud and chargeback abuse will be reported to the payment provider.

12. Ending your license

If you break these terms, open a chargeback for a product that was delivered to you, or pay with a stolen or unauthorised payment method, your license ends immediately, without a refund. We may remove your access to downloads and Discord roles and close your account. When a license ends you must stop using the files and delete your copies.

13. No warranty

The site and all products are provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will always be available or free of errors, or that products will meet your requirements.

14. Limit of liability

To the fullest extent the law allows:

• we are not liable for any indirect, incidental, special, consequential or punitive loss, or for lost profits, lost revenue, lost data, server downtime, loss of players or community, or account or server bans, however they arise;
• our total liability for any claim connected with the site or a product is limited to the amount you paid us for the product the claim is about.

You use our products on your server at your own risk.

15. Your responsibility to us

You agree to cover our losses and costs (including reasonable legal fees) from any claim made against us because you broke these terms, misused a product, or broke a law or someone else's rights.

16. Changes

We may change or remove products, prices and these terms. The date at the top shows when the terms were last updated. The terms in place when you place an order apply to that order. If you keep using the site after a change, you accept the updated terms.

17. Disputes and governing law

If you have a problem, contact us on Discord or at support@bluevalormods.com first and give us 30 days to try to resolve it. These terms are governed by the laws of the place where BlueValor Modifications is based, without regard to conflict-of-law rules. To the extent the law allows, any claim must be brought on an individual basis, not as part of a class or group action, and within one year of the event it is about.

18. General

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms, the Refund Policy and the Privacy Policy are the whole agreement between you and us about the site and its products. Nothing in these terms removes rights that the law gives you and that cannot be waived by agreement.
